Privacy Policy

This Privacy Policy describes the policies and procedures Costanzo Law Firm, APC (“CLF,” “We,” “Us,” “our,” or “Firm” ) regarding the collection, use, and disclosure of your personal information through your access to and use of our website (the “Site”), including the interactive features of our Site. In this policy, you can learn what kinds of information we collect; when and how we might use that information; how we protect the information; and the choices you have with respect to your personal information.

This Privacy Policy covers the treatment of personally identifiable information, or information that would allow someone to identify or contact you (“Personal Information”), that we gather when you use the Site.

This Privacy Policy does not apply to the practices of third parties we do not control, including any third-party services, websites, or applications that you elect to access through the Site (“Linked Third Parties”), or to individuals whom we do not manage or employ. We encourage you to review carefully the privacy policies of any Linked Third Parties you choose to access.

We may amend this Privacy Policy from time to time. Any such amendments will be effective as of the date they are posted on the Site. Each time the Privacy Policy is amended, the “Date Updated” field located below will be updated. CLF’s use of any information it collects is subject to the Privacy Policy in effect at the time of collection. You agree to be bound by any amendments to the Privacy Policy if you access or use the Site after such amendments have been posted. Thus, we advise you to refer to this Privacy Policy regularly for any amendments.

What personal information is collected through this Site and how is it used?

We collect information about our users in two ways: from web server logs automatically collected through your access to and use of the Site and from user-supplied information . We use the information primarily to provide you with a personalized experience that delivers the information that is most helpful to you. We don’t share any of the information you provide with others, unless we say so in this Privacy Policy, or when we believe in good faith that the law requires it.

1. Web Server Logs

When you visit our Site, we may track information about your visit and use of the Site, and store that information in web server logs, which are records of the activities on our Site. The servers automatically capture and save the information electronically. The information we collect in web server logs helps CLF and its agents to administer the Site, analyze its usage, protect the Site and its content from inappropriate use, improve the user’s experience, and help our marketing efforts. Examples of the information we may collect include:

  • Add your content… your unique MAC or Internet Protocol address;
  • the name of your unique Internet Service Provider;
  • the town/city, county/state and country from which you access our website;
  • the kind of browser, operating system, and/or computer or hardware you use, including whether you access the site with a mobile device;
  • the links you click on our Site;
  • the date and time of your visit;
  • the last web page you visited before accessing our Site;
  • the pages you visit on the Site and time spent accessing those pages;
  • search terms or queries that you enter on the Site.

2. User-supplied information

Public Commenting Interactive Features

Users may use the public commenting functionalities of our Site (such as likes or comments on articles or blogs posted on our Site). Any information you provide using such commenting functionalities (“Public Commenting Interactive Features”) will be considered public unless otherwise required by applicable law and is not subject to the privacy protections referenced herein. When you provide information on the Public Commenting Interactive Features, please use caution and provide only limited information or information that you are willing to be made public.

Please do not submit any confidential, proprietary, or sensitive personally identifiable information (e.g., any Social Security Number or tax identification number; age and/or date of birth; drivers’ license, passport, or identification card number; or any credit card, bank account or other financial information) (collectively, “Sensitive Information”) through the Public Commenting Interactive Features. If you submit any Sensitive Information through the Public Commenting Interactive Features, you do so at your own risk and we will not be liable to you or responsible for consequences of your submission.

Subscriptions

When you subscribe to receive alerts, newsletters, event announcements, or surveys or register to receive certain content and we may make available, including on the Client Portal, we collect your name, email address, physical address, and phone number. We may use such information you provide to us to send you emails, content, or mailings which you have requested, or to which you have subscribed, or that our Firm believes may be of interest to you; to respond to your inquiries; for recordkeeping purposes related to sending you such emails, contents, mailings, or subscriptions; for our Firm’s own internal business purposes, such as improving or modifying the Site or understanding the demographics of the Site’s users; or as otherwise described in this Privacy Policy.

If you do not wish to receive such communications, you may opt out (unsubscribe) as described below.

Free Intake Form Evaluation and Chat Interactive Features

If you fill out the general contact Free Intake Form Evaluation form (“Free Intake Form Evaluation”) or use the chat interactive features (“Chat Interactive Features”) on our Site, we will ask you to provide some personal information (such as e-mail address, name, phone number, and your city and state).

On the Chat Interactive Features, we ask that you only provide the additional general information requested by the chat agent.

For both the Free Intake Form Evaluation and Chat Interactive Features, please do not submit any confidential, proprietary, or sensitive personally identifiable information (e.g., any Social Security Number or tax identification number; age and/or date of birth; drivers’ license, passport, or identification card number; or any credit card, bank account or other financial information) (collectively, “Sensitive Information”) through the contact form. If you submit any such Sensitive Information through the Free Intake Form Evaluation or Chat Interactive Features, you do so at your own risk and we will not be liable to you or responsible for consequences of your submission.

Information that you provide to us through this Free Intake Form Evaluation or Chat Interactive Features will be used so that we may respond to your inquiry or to communicate with you in the future, and for the administration, review, and/or improvement of content of the Site. If you do not wish to receive such communications, you may opt out (unsubscribe) as described below.

Potential Client Intake Forms

Our Site may also provide links to, or we may email or text you a link to, our Potential Client Intake Forms (the “Potential Client Intake Forms”) These Potential Client Intake Forms will be clearly labeled as such.

On these Potential Client Intake Forms, we will ask you to provide personal information (such as first name, middle name, last name, company affiliation, e-mail address, physical address, state, phone number, date of birth, gender, and how you located our firm. Also, depending on the type of case, the questions may include detailed and/or personal information related to your potential matter, to help evaluate your potential matter, such as, without limitation, dates, events, names of potential defendants, and names of witnesses.

When we collect information on the Potential Client Intake Form from a potential client, this information is treated by our Firm as strictly confidential. The information is used only for the purpose of evaluating your potential legal matter and for the Firm to conduct a conflict check to determine if we have any potential conflicts with any aspects of your potential legal matter. Your personal information will also be used in the event that you hire the Firm to represent you, and the Firm agrees to represent you, in your legal matter, as necessary in the course of your matter.

Our Firm protects our potential clients’ privacy. The data submitted via these Potential Client Intake Forms are encrypted and secured using industry-standard security.

However, use of any Potential Client Intake Form does not create an attorney-client relationship with our Firm; such a relationship requires a signed, written fee agreement and retainer and administrative deposit with our Firm.

Client Portal

Through its Site, or by other means, the Firm may grant its clients access to the online Client Portal (“Client Portal”), a third-party service hosted and processed for us on behalf of our clients by our third-party agent, through third party services which are separate from the Site.

If we grant a client such access, the client may choose to provide us with certain data of that client’s own, which may contain personal information, through our Client Portal.

Except as stated in this Privacy Policy, any information provided through the features and functionalities of the Client Portal is collected and processed separate from this Site in order to furnish clients with materials about our services; to process data on behalf of our clients (including without limitation sending and receiving documents, providing billing statements and invoices, and processing payments by our clients); and otherwise to provide legal services to our clients.

The Client Portal is used only once an attorney-client relationship is established, which requires a contract signed by both the client and the Firm and deposit of our administrative fee and any retainer.

All nonpublic information received from a client is strictly confidential and our Firm protects our clients’ privacy. We restrict access to nonpublic personal information about clients to those members of our Firm who need to know that information to provide services to our clients. We maintain physical, electronic, and procedural safeguards that comply with federal regulations to guard our clients’ nonpublic personal information. The data submitted via the Client Portal is encrypted and secured using industry-standard security and is stored by our third-party agent on secure servers located secure datacenters. Please note that data on the Client Portal is shared with the client’s intended recipient.

Additionally, we do not disclose any nonpublic personal information about our clients or former clients to anyone, except as required by law.

Website Links

Our website may contain links to other websites owned and operated by third parties. If you click these links, you will be directed to that third party’s site. We do not have control over other websites. We cannot be responsible for the protection and privacy of any information which you provide while visiting such sites. This privacy policy does not govern external sites.

California Do Not Track

We do not track visitors over time or across third-party websites and therefore do not respond to Do Not Track (DNT) requests. Our web services do not alter, change, or respond upon receiving DNT requests or signals in browsers. As described in more detail above, we track user activity using web server logs and similar technologies. Information collected in web server logs helps us analyze website usage and improve the user’s experience.

How is personal information protected?

We take certain appropriate security measures to help protect your personal information from accidental loss and from unauthorized access, use, or disclosure. However, we cannot guarantee that unauthorized persons will always be unable to defeat our security measures.

Who has access to the information?

We will not sell, rent, or lease mailing lists or other user data to others, and we will not make your personal information available to any unaffiliated parties, except as follows:

  • to agents, website vendors, and/or contractors who may use it on our behalf or in connection with their relationship with us;
  • if we are unable to assist with your matter, but know an unaffiliated attorney or firm that may be able to help you, we may refer you and share information you provided us with that party; and
  • as required by law, in a matter of public safety or policy, as needed in connection with the transfer of our business assets (for example, if we are acquired by another firm or if we are liquidated during bankruptcy proceedings), or if we believe in good faith that sharing the data is necessary to protect our rights or property.

How can I correct, amend, or delete my personal information, opt out, and/or unsubscribe from future communications?
